There are obviously many questions people ask when considering divorce, whether you are just starting to consider it seriously for the first time or if you have already reached the conclusion that divorce is necessary and is going to happen.
When you first start thinking about divorce there are many divorce questions, and many of these will depend on whether or not you and your spouse have children. Here the questions have to do with custody and visitation rights. These are questions that have huge magnitude for all concerned. You might also have questions with regard to whether or not a separation is in order. Many couples try a trial or informal separation and just give themselves a little time and space to consider if they really want to dissolve the marriage or if down-deep there is the desire to save it. This type of separation is different from a formal separation for which separation papers are filed with the proper state authorities. This agreement will address all the major issues involved in dissolving a marriage, including custody of any children, visitation, and of course division of property, income, and spousal support.
If your marriage is basically a lost cause and both you and your spouse know in your hearts that the marriage is effectively finished and that a divorce is inevitable, many other questions come to the fore. At this point whether or not you and your spouse can come to an agreement on the major issues or whether these will be contested is of prime importance. It is far better to negotiate an agreement that both parties can accept and enter divorce court with an uncontested agreement than to have a trial and let the court make the decisions. These days there are even elaborate systems for mediation to resolve these issues. Over the years the concept of no-fault divorce is prevalent and followed to some extent in every state but New York. It is even possible to avoid having an attorney involved, which can save considerable expense.
